ART. 1 INTRODUCTION

The services offered by Comebag®, a trademark owned by Temi Spa, are governed by these “Terms and Conditions of Service”. These Terms and Conditions constitute an integral part of every individual storage and/or transportation contract, as well as any other service agreements entered into with the Customer. They are considered inseparable from the contract itself.

ART. 2 DEFINITIONS

The following definitions apply to the “Terms and Conditions of Service” which govern the storage contract and any other service agreements with the Customer:

  • “we”, “us”, “our”, and “personnel in charge” refer to COMEBAG and its partners and collaborators.
  • “Customer(s),” “you” and “your” refer to the Customer holding a storage receipt, hereinafter referred to as “receipt”.

ART. 3 TERMS AND CONDITIONS

The contract for storage and other services is entered into with Temi Spa, which:

Temi Spa agrees to provide storage and/or transportation services for the luggage and items of its Customers at its designated luggage storage facilities. By depositing your luggage at our facilities or within our baggage storage system, you accept the terms and conditions specified in our storage and/or transportation contract, as well as any additional service agreements, whether these agreements are made on your behalf or for the benefit of other interested parties. The company reserves the right to perform the transportation service at its sole discretion and in accordance with the conditions set forth herein. This includes the option to utilize third-party carriers for the execution of the transport service.

ART. 4 DESCRIPTION OF THE SERVICE

Comebag (Temi Spa) provides a luggage storage service that allows Customers to store their baggage (for a duration selected at the time of booking) at designated locations or to arrange for the transportation of their luggage to the required destination.

Comebag collection/storage points are open, unless otherwise stated on our website or by notices displayed at Comebag locations, from Monday to Sunday, between 8:00 AM to 8:00 PM.

  • Please be aware that the Customer does not have the right to withdraw from the transaction due to the specific nature of the service, and that all bookings are non-refundable.
  • The e-mail confirmation and/or receipt issued by Comebag serve as confirmation of booking.
  • Reservations can be made through digital platforms (website – APP – via email) or in person at one of our locations.
  • The storage of animals of any kind is prohibited, and their entry into Comebag facilities is not allowed.
  • Smoking is prohibited within our storage facilities.
  • Access to the service is restricted to individuals aged 18 years or older, or accompanied minors.
  • Perishable food items must not be stored in the luggage. The same applies for explosives, weapons, as well as all goods deemed dangerous under national legislation.
  • The maximum allowable weight per item is 40 kg.
  • The Customer is responsible for ensuring that their luggage complies with size and weight restrictions before making a reservation and for selecting the appropriate rate. Any necessary adjustments to the rate due to service requirements will be charged before the service commences.
  • No claims or refund requests will be accepted if the luggage exceeds the specified size and/or weight limits.
  • The Customer must ensure that their luggage is securely closed before leaving the storage facility, preferably using their own security locks, and verify any security seals applied by the operator.
  • The Customer must not leave valuable items or prohibited items, as detailed in Article 7, in their luggage. The Customer remains responsible for such items, and Comebag (Temi Spa) disclaims all liability. Any valuable items must be reported to staff at the time of storage; staff will, at their sole discretion, assess whether these items can be stored in addition to the main luggage.
  • The Customer is fully responsible for their luggage and its contents, and no claims
  • The Customer must ensure that no identification documents or other essential items required for travel are left in the luggage.

ART. 5 LATE COLLECTION FROM BAGGAGE STORAGE

In the event of a delayed collection of luggage during the baggage storage facility’s operating hours, Comebag will impose a supplementary charge equivalent to one additional day of storage for each day of delay. The Customer will be able to retrieve their luggage upon settlement of these charges.

Should the Customer attempt to collect their luggage outside the official operating hours of the Comebag location, they may request home delivery at their own expense by contacting us via e-mail to arrange the service.

ART. 6 FORGOTTEN/FOUND LUGGAGE

For security reasons, any item or luggage that is forgotten or found and remains unclaimed will be destroyed.

If a request is made to forward a forgotten item, the Customer will be responsible for all related costs, which must be paid in advance. A handling fee of €10.00 – in addition to shipping costs, which will be calculated based on the weight, destination, and shipping method – will apply.

ART. 7 PROHIBITED AND DANGEROUS ITEMS

The storage of items prohibited by law and/or deemed dangerous under national legislation is strictly prohibited. This includes items that, by their nature or packaging, may cause harm to individuals, the environment, or other stored and/or transported luggage.

We do not accept storage, nor provide services for items that we, at our sole discretion, consider dangerous. Comebag by Temi Spa does not accept the storage of the following items: plants and animals, whether alive or dead; negotiable titles (bills of lading, currency, banknotes, coins, credit cards, and travelers’ cheques); other non-negotiable titles; any material that may be considered pornographic or indecent; weapons (firearms and knives); software containing high-value information; technology (phones, tablets, PCs, smartphones); waste; political materials; hazardous and explosive materials; narcotics or psychotropic substances; works of art; antiques; metals (gold, silver in any form, and precious stones); bulky goods; documents (public and private offers, securities, meal vouchers, and fuel coupons, etc.); and watches.

The following items may only be accepted by Comebag (Temi Spa) with prior written authorization or if they are expressly part of Comebag (Temi Spa)’s commercial offering: food and pharmaceutical products; cigarettes and alcohol; fragile items (such as glass, bottles, etc.); biological tissues and anatomical parts.

The Customer acknowledges and agrees that the storage of such items is subject to specific regulations. Therefore, the storage of such items must comply with current legislation and any operational guidelines provided by Comebag (Temi Spa). These guidelines may be subject to change at any time.

ART. 8 RIGHT OF INSPECTION

The Customer acknowledges and agrees that Comebag (Temi Spa) and/or any Government Authority have the right to open and inspect the luggage at any time for security reasons and at their sole discretion, including conducting explosives and drug checks using specialized equipment known as Sniffer.

ART. 9 CUSTOMER OBLIGATIONS

The Customer warrants and declares that:

  • (A) For staffed baggage storage, the contents of the luggage have been accurately provided on our storage receipt;
  • (B) The complete address and contact details have been accurately provided on our storage receipt or online form;
  • (C) The contents of the luggage have been securely and properly packed to protect them against the normal risks of transportation, including any associated sorting and/or handling processes;
  • (D) The contents of the luggage do not pose a risk to other luggage transported and/or stored at our facilities;
  • (E) The contents of the luggage do not include prohibited items, and the Customer is not a person or entity with whom we are legally prohibited from engaging in commerce under applicable laws or regulations;
  • (F) If the storage fee is charged to a third party and payment is not received, the Customer will be liable for the service cost;
  • (G) All applicable laws and regulations, as well as the provisions of this agreement, have been complied with;
  • (H) The economic value of each piece of luggage, including its contents, does not exceed €500.00.

The Customer agrees to indemnify and hold us harmless from any liability, cost, damage, or expense, including legal fees, that we may incur as a result of any breach of these warranties, obligations, and representations by the Customer, even if we inadvertently accept an item for storage that contravenes any of the Customer’s obligations.

ART. 10 EXTENT OF OUR LIABILITY

Our liability for any total loss or damage to your luggage during the storage period at our facility and/or during transportation, which is specifically solely attributable to Comebag (Temi Spa) or its employees, shall be governed by applicable laws and regulations. Under no circumstances shall such liability exceed the amount of €500.00 per piece of luggage, as covered by the insurance specified in Article 11 of these terms and conditions.

For matters not address by the provisions of the Civil Code regarding storage contracts, Comebag (Temi Spa) shall bear no liability for luggage delays or for uncollected luggage beyond our specified operating hours.

Accordingly, Comebag (Temi Spa) shall not be responsible for any damages, whether directly and foreseeably or indirectly caused by delays or failure to collect luggage.

Comebag (Temi Spa) shall not be liable for any missed flights, trains, connections, lost income, profits, market opportunities, reputation, customers, usage, or other opportunities, even if aware of the potential for such losses or damages. We shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to contract termination, negligence, fraud, or non-performance. We shall not be liable for failure to meet any obligation due to circumstances beyond our control, including but not limited to: force majeure such as earthquakes, cyclones, storms, floods, fires, diseases, fog, snow, or frost; force majeure events including (but not limited to) war, accidents, terrorism, strikes, embargoes, local disputes, or civil disturbances; national or local disruptions; hidden defects or intrinsic defects in the contents of the stored luggage; criminal acts by third parties such as theft, robbery, and arson; acts or omissions attributable to you or third parties for whom you are responsible; acts or omissions attributable to public officials; contents of the shipment consisting of any item prohibited by law or under the terms of this agreement, even if we have accepted the shipment and/or storage in error. We are not responsible for broken handles and/or wheels. The sole liability of Comebag (Temi Spa) concerning the services provided is governed by these general terms and conditions of storage.

ART. 11 INSURANCE

Each piece of luggage stored with our company is insured by a leading insurance provider up to a maximum value of €500.00 per item. This insurance coverage compensates the customer for any damages and/or total losses directly attributable to Comebag (Temi Spa) within the limits aforementioned, including proven theft by third parties.

The following items are excluded from insurance coverage: precious stoned, precious metals, watches, plasma screens, LCDs, satellite navigation systems, mobile phones, PCs, tablets, jewellery, money, glass, porcelain, artwork, antiques, documents, films, tapes, disks, memory cards, or any other media containing data or images. The insurance options do not cover: consequential losses, delayed deliveries, losses arising from a breach of Customer obligations under these terms and conditions, services unrelated to transportation, breakage of handles and/or wheels.

All our facilities are equipped with 24-hour video surveillance, connected to a private control and monitoring centre.

ART. 12 CLAIMS AND DISPUTES

Customers who wish to file a claim for loss or damage to luggage, or any other type of damage, must adhere to the relevant national legal provisions. Failure to comply may result in the rejection of the claim. Claims must be submitted in writing within eight (8) calendar days from the date on which the storage and/or transportation service concludes. Subsequent to the initial written notification, and within the statutory limitation period as prescribed by applicable law, the customer must provide documentary evidence to support their claim. This includes submitting all pertinent information related to the incident. No action will be taken on any claim until all applicable fees and service charges have been settled. For damage claims to be considered, the contents of the luggage must be made available for inspection at the time of collection. Should we accept the claim, the Customer must ensure that the insurance company or any third parties with a vested interest in the storage will forfeit any rights or claims they may have through subrogation or other means.

ART. 13 PAYMENT TERMS AND DISPUTES

Any disputes regarding charges for services provided by Comebag (Temi Spa) must be submitted in writing within seven (7) days from the date of payment. Current rates for storage services are available upon request at our locations in Naples, including at the Airport (Palazzina Pegaso) and the Naples Port Terminal, as well as on our official websites. The Customer agrees to pay the amount due to Comebag (Temi Spa) as specified in these terms and conditions. Payments must be made in the local currency and will be based on the applicable exchange rate at the time of payment. In the event of late payment, default interest may be charged in accordance with Legislative Decree No. 231/02 and subsequent amendments. Comebag (Temi Spa) reserves the right to pursue collection of outstanding amounts as permitted by law, in addition to any rights to claim further damages..

ART. 14 GOVERNING LAW

If any provision of this Agreement is found to be invalid or unenforceable, such determination shall not affect the validity or enforceability of the remaining provisions, which will continue to be in full force and effect. Except where otherwise provided by applicable law, all disputes arising out of or in connection with this Agreement shall be governed by the laws of Italy.

ART. 15 JURISDICTION

Any disputes arising from or related to the relationship between the parties shall be exclusively subject to the jurisdiction of the consumer court, in accordance with Article 33, paragraph 2, of Legislative Decree No. 206/2005 and subsequent amendments.
